Having a fair disciplinary procedure is essential for dealing effectively with any employee misconduct, while minimising the risk of successful tribunal claims. There is no statutory disciplinary procedure but the Acas Code of Practice on disciplinary and grievance procedures, together with relevant case law establish some basic principles that must be followed.

Investigations are essential too – a thorough investigation must be carried out in any case of suspected employee misconduct or any grievance allegation and the investigating officer cannot then be involved in any subsequent hearing. Capability Issues
Sometimes employees underperform through no fault of their own – perhaps because they do not have the necessary skills to do their job, or have had so much time off sick that an unfair burden is placed on the rest of the team. In these situations a capability procedure is the appropriate tool to use for managing an employee back to full performance or, if necessary, out of the business. Particular care is needed in handling ill-health dismissals to ensure you will not be faced with a disability discrimination claim at a later date.
